1. Acceptance of Terms

By downloading, installing, accessing, or using the Trakium mobile application ("App") provided by Our Apps World ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

2. License Grant & Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal or internal business purposes on compatible iOS or Android devices that you own or control.

You agree not to:

• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
• Modify, translate, adapt, or create derivative works of the App.
• Use the App to track individuals or vehicles without their lawful knowledge and explicit consent.
• Interfere with, circumvent, or disrupt the integrity or security of any connected Traccar server or network.

3. Traccar Server Connection & Account Responsibility

Trakium connects to backend servers running the open-source Traccar GPS tracking platform. You acknowledge and agree that:

• You are solely responsible for ensuring the legality, uptime, and data protection policies of any external Traccar server to which you connect the App.
• You are responsible for maintaining the confidentiality of your server account credentials and for all activities that occur under your account.
• Our Apps World is not responsible for data loss, server downtime, hardware failures, or network interruptions caused by your chosen Traccar server provider or third-party telecommunications carriers.

4. Permitted Use & Regulatory Compliance

GPS tracking of vehicles, assets, and personnel is subject to regional and national surveillance, labor, and privacy laws. You represent and warrant that your use of Trakium complies with all applicable local laws, including obtaining any required driver notifications, union agreements, or consent forms before deploying tracking hardware.

5. Intellectual Property

The Trakium application, logos, trademarks, visual design, custom UI components, and software code are the intellectual property of Our Apps World. Traccar is a registered trademark of Traccar LLC. Google Maps is a trademark of Google LLC. Apple Maps is a trademark of Apple Inc.

6. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OPERATION OF THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE AT ALL TIMES DUE TO THE INHERENT LIMITATIONS OF GPS SATELLITE COVERAGE AND CELLULAR CONNECTIVITY.

7. Limitation of Liability

IN NO EVENT SHALL OUR APPS WORLD, ITS OFFICERS, DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, VEHICLE THEFT, PROPERTY DAMAGE, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Bangalore, Karnataka, India.
